Following are the Terms and Conditions that apply for use of Tappi published by Tappi, Inc. and available by visiting the Google Play Store or the Tappi website at tappi.app.

For the purposes of these terms and conditions, the user shall be referred to as “You” or “Your”; Tappi, Inc. shall be referred to as the “Company”; and Tappi shall be referred to as the “App.”

Your access and use of the App constitutes Your agreement to be bound by these Terms and Conditions, which establishes a contractual relationship between You and the Company. If You do not agree to these Terms and Conditions, You may not access or use the App. These Terms and Conditions expressly supersede all prior agreements or arrangements with You.

SERVICE DESCRIPTION

The services constitute a technology platform that enables users of the App and related websites to create Facebook and Instagram ads and save their customer database and send bulk SMS to their customers. Users also receive a free webpage upon sign up with their business details. (Collectively the “Services”) For the purposes of this clause, Services would include any other future services the Company provides/proposes to provide.

ACCOUNT OPENING AND MAINTENANCE

In order to use the Services, you must register for and maintain an active business user account (the “Account”). You must be at least 18 years of age to obtain an Account. Registration requires you to submit to the Company certain personal information, such as your business name, address, phone number and business details, as well as relevant business product or service images.

By opening an Account, You agree that You own or represent a legal business, maintain accurate and complete business records, and will maintain up-to-date information in Your Account. Failure to comply may result in your inability to access and use, or termination of, Your Account and the Services. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your sign in credentials at all times. Unless otherwise permitted by the Company. You may only have one Account at any given time.

ADVERTISING

The App allows You to create paid advertisements linked to Facebook and Instagram. Advertisements created on the App may either be “in review,” “approved” or “rejected". Once an advertisement is created it is assigned “in review” status. Typically, the advertisement will be approved or rejected within 24 hours.

    An advertisement may be rejected because:

  • it violates the Facebook Community Standards that apply to Your use of the App;
  • it is unlawful, misleading, discriminatory or fraudulent; or
  • it infringes or violates someone else's rights, including their intellectual property rights.

By creating an advertisement on the App, You agree to comply with the Facebook Community Standards as updated from time to time. The Company shall receive all notifications that and advertisement and such rejection will be communicated to You.

TEXT MESSAGING

By creating an Account, You agree that the Company may send you text (SMS) messages as part of the normal business operation of Your use of the Services. You may opt-out of receiving messages at any time by contacting customer support on Call or WhatsApp For Kenya +254115574380 and Nigeria +2349136000761. You acknowledge that opting out of receiving text messages may impact Your use of the Services

PROMOTIONAL CODES

The Company may, in sole discretion, create promotional codes that may be redeemed for Account credit, or other features or benefits related to the Services and/or a third party’s services, subject to any additional terms that the Company establishes on a per promotional code basis (the “Promo Codes”).

You agree that Promo Codes: (i) must be used for the intended audience and purpose, and in a lawful manner; (ii) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise), unless expressly permitted by the Company; (iii) may be disabled by the Company at any time for any reason without liability to the Company; (iv) may only be used pursuant to the specific terms that the Company establishes for such Promo Code; (v) are not valid for cash; and (vi) may expire prior to Your use.

The Company reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Promo Codes by You or any other user in the event that the Company determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or these Terms and Conditions.

PRIVACY

The Company’s Privacy Policy sets forth how the Company collects, uses and shares Your personal data. By using the App, You acknowledge and agree that the Company may use such data in accordance with Privacy Policy.

SECURITY

You understand that use of the App may result in charges to You for the services or goods you receive as a result of such use (the “Charges”). The Company will facilitate Your payment of the applicable Charges. Charges will be inclusive of applicable taxes where required by law. Charges paid by You are final and non-refundable, unless otherwise determined by the Company.
